GENERAL TERMS AND CONDITIONS OF SALE

These terms of sale are concluded on the one hand by the company

and, on the other hand, by any individual or legal entity wishing to make a purchase via the website monpetitart.com, hereinafter referred to as "the buyer".

CLAUSE NO. 1: PURPOSE

These terms of sale are intended to define the contractual relationship between Les Editions Lucine SARL and the buyer and the conditions applicable to any purchase made through the website monpetitart.com. The purchase of a product through this site implies unreserved acceptance by the buyer of these terms of sale, which the buyer acknowledges having read prior to placing the order. Before any transaction, the buyer declares that they have full legal capacity to enter into these general terms and conditions of sale.
Les Editions Lucine SARL reserves the right to modify these terms of sale at any time, in order to comply with any new regulations or to improve the use of its site. Therefore, the applicable conditions will be those in force on the date of the order by the buyer.

CLAUSE NO. 2: PRODUCTS

The products offered are those listed on the monpetitart.com website of Les Editions Lucine SARL, subject to availability. Les Editions Lucine SARL reserves the right to modify the product assortment at any time.
Each product is presented on the website with a description of its main technical characteristics. The photographs are as accurate as possible but are not binding on the seller. The sale of the products presented on the monpetitart.com website is intended for all buyers residing in countries that fully authorize the entry of these products into their territory.

CLAUSE NO. 3: PRICES

Prices are indicated in euros, all taxes included, and are only applicable on the date the order validation is sent by the buyer.
Prices do not include delivery charges, gift wrapping fees, possible promotional offers, and personal discounts, which are indicated before the final validation of the order.
Prices include the French VAT applicable on the day of the order, and any change in the legal VAT rate will automatically be reflected in the price of the products presented on the site, on the date stipulated by the implementing decree. However, prices cannot be changed once the Buyer's order has been placed.
Orders destined for countries outside the European Union are not subject to French VAT. The prices indicated on the site for these orders are exclusive of tax and therefore do not include VAT. However, these orders are subject to any taxes and customs duties of the destination country.
The buyer is also responsible for checking the import possibilities of the ordered products with regard to the law of the country of delivery.

CLAUSE NO. 4: ORDER PROCEDURE

For any order:
- The buyer must identify themselves either by entering their email address and password, which are strictly personal, or by providing all the information usually required to create an account.
At each visit, the buyer, if they wish to order or consult their account (order status, profile, etc.), must identify themselves using this information.
The account creation section is accessible at any time during site navigation by clicking on the "person" icon directly from the menu bar at the top.
- The buyer must indicate the desired quantities for each product and then confirm their selection by clicking on "add to cart"
- The buyer must clearly indicate the information necessary for delivery. This particularly concerns the precise delivery address, as well as any access restrictions to the delivery location (building, floor, entry code, etc.);
- The buyer must indicate the chosen delivery method;
- The buyer must finally indicate the chosen payment method.
Once the payment method is selected, the buyer must proceed to pay for their order, which will formally and definitively establish the sales contract binding them to the seller

Any order implies acceptance of the prices and description of the products available for sale. Any dispute on this point will occur within the framework of a possible exchange and the guarantees mentioned below.

CLAUSE NO. 6: PAYMENT METHODS AND INVOICING

PAYMENT METHODS
The buyer can pay for their order online by credit card (Carte Bleue, Visa, Mastercard) or by Paypal.
The buyer guarantees to Les Editions Lucine that they have any necessary authorizations to use the payment method chosen by them when validating the order form. The buyer's account is debited at the time of the order.
Les Editions Lucine implements all necessary means to ensure the security and confidentiality of data transmitted online. For this purpose, the site uses a secure SSL (Secure Socket Layer) payment method that allows the encryption of bank details during their transmission over the network. The transaction is carried out via the Societé Marseillaise de Crédit bank, which alone has the banking information provided on the site at the time of payment.

If you have a Paypal account, you can pay for your purchases directly via this service. Paypal carries out secure and encrypted transactions without ever communicating your banking details to the recipients; your email address and password are sufficient.
You can also pay by Paypal if you do not have a Paypal account, and pay directly with your Carte Bleue, deciding whether or not to register later on Paypal.com.
Les Editions Lucine reserves the right to suspend any order management and delivery in the event of refusal of payment authorization by credit card from officially accredited organizations or in the event of non-payment.

INVOICING
An invoice is issued for each order and will be included with the shipment of the product(s). Any complaint regarding invoices must be brought to the attention of Les Editions Lucine within 7 days of receipt. Failing this, they will be considered accepted without reservation.
The seller keeps an electronic copy of each invoice.

CLAUSE NO. 7: RETENTION OF TITLE

Les Editions Lucine retains full ownership of the products sold until full payment of the price, including principal, fees, and taxes.

CLAUSE NO. 8: DELIVERY

Delivery is carried out by a transport company. The delivery time indicated when the order is recorded is given for information only and is not guaranteed. Consequently, any reasonable delay in the delivery of the products cannot give rise to any compensation or cancellation of the order for the benefit of the buyer. However, Les Editions Lucine will make its best efforts to ensure that the products are delivered within the indicated timeframes, i.e., less than one week upon receipt of payment. The risk of transport is borne entirely by the buyer. In the event of missing or damaged goods during transport, the buyer must make all necessary reservations on the delivery note upon receipt of said goods. The buyer is required to check, in the presence of the postal worker or delivery person, the condition of the packaging and the contents of the goods upon delivery. These reservations must also be confirmed in writing within 7 days of delivery, by registered letter with acknowledgment of receipt.

CLAUSE NO. 9: RIGHT OF WITHDRAWAL

The buyer has a period of 14 days to withdraw and notify the seller. This period runs from the receipt of the order. The products must be returned no later than 14 days following notification of withdrawal, undamaged, to the following address: Les Editions Lucine, DSL, 16 Chemin de la Glacière, 06200 NICE. Les Editions Lucine will then refund the amount paid by the buyer for the returned product(s), except for outbound and return shipping costs.

CLAUSE NO. 10: WARRANTY

All products supplied by Les Editions Lucine benefit from the legal warranty provided for by articles 1641 and following of the Civil Code. In the event of non-conformity of a product sold, it may be returned to Les Editions Lucine, which will take it back, exchange it, or refund it. All claims, requests for exchange or refund must be made by post to the following address: Les Editions Lucine, DSL, 16 Chemin de la Glacière, 06200 NICE, within thirty days after delivery.

CLAUSE NO. 11: LIABILITY

Les Editions Lucine, in the process of distance selling, is only bound by a best-efforts obligation. Its liability cannot be engaged for damage resulting from the use of the Internet such as loss of data, intrusion, virus, service interruption, or other involuntary problems.

CLAUSE NO. 12: INTELLECTUAL PROPERTY

All elements of the monpetitart.com site are and remain the intellectual and exclusive property of Les Editions Lucine. No one is authorized to reproduce, exploit, or use in any way, even partially, elements of the site whether in the form of photos, logos, visuals, or text.

CLAUSE NO. 13: FORCE MAJEURE

Les Editions Lucine will not be responsible for the total or partial non-performance of its obligations under this contract if such non-performance is caused by an event constituting force majeure, in particular in the event of disruption or total or partial strike, especially of postal services and means of transport and/or communications, fire, flooding, equipment failure or breakdown, or due to the actions of the Buyer.

CLAUSE NO. 14: DATA PROTECTION AND PRIVACY

Providing personal information collected as part of distance selling is mandatory, as this information is necessary for processing and delivering orders as well as for issuing invoices. This information is strictly confidential. Failure to provide it will result in automatic rejection of the order. In accordance with Law No. 78-17 of January 6, 1978, relating to data processing, files, and freedoms, the processing of personal information collected on the Site has been declared under No. 2116546 v 0 to the National Commission for Data Protection and Liberties. The buyer has the right to access, modify, rectify, and delete data concerning them.
To exercise this right, the buyer must log in to the Site or send a letter to Les Editions Lucine, 350 Chemin Pré Neuf, 38350 La Mure. In any case, the user must provide their last name, first name, address, and, if applicable, their buyer number.

CLAUSE NO. 15: DISPUTE RESOLUTION

These terms are subject to French law.
Contracts concluded through our website as well as any disputes related to them will be subject to French law.
An amicable solution (such as mediation) must be considered before any legal action.
