These terms of sale are concluded on the one hand by the company Les Editions Lucine SARL with a share capital of 7500 euros, whose head office is located at 23 le parc de Puget, 84360 Puget, France, tel: +33(0)954407330, email: info@monpetitart.com, registered with the Avignon Trade and Companies Register (RCS) under number RCS 483 840 971, hereinafter referred to as "the seller" and managing the monpetitart.com website and, on the other hand, by any natural or legal person wishing to make a purchase via the monpetitart.com website, hereinafter referred to as "the buyer".

CLAUSE N° 1: PURPOSE

These conditions of sale aim to define the contractual relationship between Les Editions Lucine SARL and the buyer and the conditions applicable to any purchase made through the monpetitart.com website. The acquisition of a product through this site implies unreserved acceptance by the buyer of these terms of sale, which the buyer acknowledges having read prior to placing their order. Before any transaction, the buyer declares that they have full legal capacity, allowing them to commit under these general terms and conditions of sale.

The company Les Editions Lucine SARL reserves the right to modify these terms of sale at any time, in order to comply with any new regulations or with the aim of improving the use of its site. Therefore, the applicable conditions will be those in force on the date of the order by the buyer.

CLAUSE N° 2: PRODUCTS

The products offered are those listed on the monpetitart.com site of the company Les Editions Lucine SARL, within the limits of available stock. The company Les Editions Lucine SARL reserves the right to modify the product assortment at any time.

Each product is presented on the website in the form of a description outlining its main technical characteristics. The photographs are as accurate as possible but do not bind the seller in any way. The sale of products presented in the monpetitart.com site is intended for all buyers residing in countries that fully authorize the entry of these products into their territory.

CLAUSE N°3: PRICE

Prices are indicated in euros, including all taxes (TTC), and are only applicable on the date the order validation is sent by the buyer.

Prices do not include delivery costs, gift wrapping costs, possible promotional offers, and personal discounts, which are indicated before the final validation of the order.

Prices take into account the French VAT applicable on the day of the order, and any change in the legal VAT rate will be automatically reflected in the price of the products presented on the site, on the date stipulated by the implementing decree. However, prices cannot be modified once the Buyer's order has been placed.

 

Orders destined for countries outside the European Union are not subject to French VAT. The prices indicated on the site for these orders are Exclusive of Taxes (Hors Taxes) and therefore do not include VAT. However, these orders are subject to any taxes and customs fees of the destination country.

The buyer is also responsible for verifying the possibility of importing the ordered products with regard to the law of the delivery country.

CLAUSE N°4: ORDERING PROCEDURES

For any order:

  • The buyer must identify themselves either by entering their email address and password, which are strictly personal to them, or by providing all the information usually required for account creation.

  • With each visit, the buyer, if they wish to order or consult their account (order status, profile, etc.), must identify themselves using this information.

  • The account creation section is accessible at any time while browsing the site by clicking on the "person" icon directly from the menu bar in the header.

  • The buyer must indicate the requested quantities for each product and then confirm their selection by clicking on "add to cart."

  • The buyer must clearly indicate the necessary information for delivery. This concerns, in particular, the precise delivery address, as well as any possible accessibility restrictions of the delivery location (building, floor, key code, etc.);

  • The buyer must indicate the chosen delivery method;

  • Finally, the buyer must indicate the chosen payment method.

Once the payment method is selected, the buyer must proceed with the payment of their order, which will firmly and definitively formalize the sales contract binding them to the seller.

This validation constitutes a signature and acceptance of all operations carried out on the monpetitart.com site.

Any order implies acceptance of the prices and description of the products available for sale. Any dispute on this point will occur within the framework of a possible exchange and the guarantees mentioned below.

CLAUSE N° 6: PAYMENT AND INVOICING METHODS

MEANS OF PAYMENT

The buyer can pay for their order online by bank card (Carte Bleue, Visa, Mastercard) or via Paypal.

The buyer guarantees to the company Les Editions Lucine that they have the necessary authorizations to use the payment method chosen by them when validating the order form. Purchases are debited from the buyer's account at the time of the order.

The company Les Editions Lucine implements all necessary means to ensure the security and confidentiality of data transmitted online. For this purpose, the site uses a secure payment method (SSL - Secure Socket Layer) which allows the encryption of bank details during their transmission over the network. The transaction is carried out via the bank Société Marseillaise de Crédit, which alone has the banking information provided on the site at the time of payment.

If you have a Paypal account, you can pay for your purchases directly via this service. Paypal carries out secure and encrypted transactions without ever communicating your bank details to the recipients; your email address and password are sufficient.

You can also pay by Paypal if you do not have a Paypal account, and pay directly with your Carte Bleue by deciding whether or not to register later on Paypal.com.

The company Les Editions Lucine reserves the right to suspend any order management and any delivery in the event of refusal of payment authorization by bank card from officially accredited bodies or in the event of non-payment.

INVOICING

An invoice is established for each order and will be attached to the shipment of the product(s). Any complaint concerning invoices must be brought to the attention of Les Editions Lucine within 7 days of their receipt. Failing this, they will be considered accepted without any reservation.

The seller retains an electronic copy of each invoice.

CLAUSE N° 7: RETENTION OF TITLE

The company Les Editions Lucine retains full and complete ownership of the products sold until the full collection of the price, including principal, costs, and taxes.
